H 1B employer sponsorship requires the hiring company to file a petition with USCIS on behalf of the foreign worker. The employer must obtain a certified Labor Condition Application from the Department of Labor, pay at least the prevailing wage for the position and geographic area, and submit Form I 129 during the annual filing window.
